National Stock Car Racing Appeals Panel Statement On No. 07 K&N East Team

The National Stock Car Racing Appeals Panel today heard and considered the appeal of the No. 07 NASCAR K&N Pro Series East team.

The penalty concerns Sections 12-1 (Actions detrimental to stock car racing); 12-4-I (Race equipment used in the event does not conform to NASCAR rules); and Section 20C-5.10.1A: (Carburetor Eligibility: The Holley 4150HP Series, list number 80509, four (4) barrel carburetor is the only carburetor approved for the NASCAR-approved “Spec Engine”. The carburetor must remain as supplied by the NASCAR-approved supplier (refer to sub-section 20C-4.1B)); Section 20C-4.1B: (No modifications to the carburetor and carburetor spacer – Must remain as supplied by the NASCAR-approved supplier: Unapproved modification to the carburetor metering block). The violation was discovered during post-race inspection on Oct. 27.

The penalties stemmed from a post-race inspection at Greenville (S.C.) Pickens Speedway following the NASCAR K&N Pro Series East event on Oct. 27.

The original penalties assessed were:

• Car owner (Randy LaJoie): Loss of 25 NASCAR K&N Pro Series East championship car owner points;
• Car driver (Corey LaJoie): Loss of 25 NASCAR K&N Pro Series East championship driver points;
• Crew chief (Ron Otto): $5,000 fine; suspended from NASCAR until fine is paid; placed on NASCAR probation for the next NASCAR K&N Pro Series East event;

The Appellant appealed all of the above penalties assessed to the No. 07 team.

Upon hearing the testimony and carefully reviewing the facts, it was a unanimous decision by the National Stock Car Racing Appeals Panel to uphold the original penalties assessed by NASCAR. Therefore, the loss of 25 championship car owner points for Randy LaJoie; the loss of 25 championship driver points for Corey LaJoie; and the $5,000 fine and probation for crew chief Ron Otto will be effective immediately.

The Appellant has the right under Section 15 of the rule book to appeal this decision to the National Stock Car Racing Chief Appellate Officer.
